1. Acceptance of Terms

By accessing, downloading, installing, or using Daily Bible App ("the App", "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the App.

These Terms constitute a legally binding agreement between you and Daily Bible App. By creating an account or using the Service, you represent that you are at least 13 years old (or the minimum age required in your jurisdiction) and have the legal capacity to enter into this agreement.

2. Description of Service

Daily Bible App provides a mobile application for reading Bible scriptures, accessing devotionals, following reading plans, and related spiritual content. The Service includes:

2.1 Core Features (Available to All Users):

• Bible text reading with multiple translations (KJV, NIV, Diodati, Almeida, and others)
• Daily verse feature with daily inspirational verses
• Basic notes and bookmarks
• Basic verse highlighting
• Reading progress tracking
• Devotionals and reading plans
• User account management and data sync
• Ad-supported free access (ads shown to free users)

2.2 Pro Features (Requires Purchase):

• Ad-free experience
• Extended daily verse history (90 days vs 30 days for free users)
• Advanced notes with rich text formatting
• Multiple highlight colors and advanced highlighting options
• Advanced reading customization (font families, line spacing, themes)
• Enhanced saved verse organization with tags and filtering
• Verse collections and custom organization
• Additional premium features as they are added

2.3 Service Availability:

• The Service is available as a mobile application for Android and iOS devices
• Some features may require an internet connection
• Bible text data may be stored locally for offline access
• Certain Bible versions may require API access (e.g., NIV via API.Bible)

3. User Account and Registration

3.1 Account Creation:

• You may be required to create an account to access certain features
• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You agree to accept responsibility for all activities that occur under your account

3.2 Account Security:

• You must immediately notify us of any unauthorized use of your account
• You may not share your account credentials with any third party
• You may not create multiple accounts to circumvent restrictions or abuse the Service
• We reserve the right to suspend or terminate accounts that violate these Terms

4. Prohibited Uses and Activities

You agree NOT to use the Service in any of the following ways:

4.1 Illegal Activities:

• Use the Service for any illegal purpose or in violation of any local, state, national, or international law
• Transmit any material that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Violate any intellectual property rights or proprietary rights

4.2 Service Abuse and Exploitation:

• Attempt to gain unauthorized access to the Service, other accounts, computer systems, or networks
• Use automated systems (bots, scrapers, crawlers) to access, scrape, or extract data from the Service
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Modify, adapt, alter, or create derivative works of the App or Service
• Remove, circumvent, disable, or otherwise interfere with security features or technical limitations
• Interfere with or disrupt the Service, servers, or networks connected to the Service
• Overload, flood, spam, or create an undue burden on the Service or its infrastructure
• Use the Service to transmit viruses, malware, or other harmful code

4.3 Data and Content Restrictions:

• Copy, reproduce, republish, upload, post, transmit, or distribute content from the Service without authorization
• Create a database by systematically downloading and storing Service content
• Use the Service content for commercial purposes without explicit written permission
• Scrape, harvest, or collect information about other users
• Use the Service to build a competing product or service

4.4 Account and Access Restrictions:

• Create multiple accounts to circumvent usage limits or restrictions
• Share, sell, or transfer your account to another person
• Use another user's account without permission
• Impersonate any person or entity or falsely state your affiliation with any person or entity

4.5 API and Technical Restrictions:

• Access the Service through any automated means (scripts, bots, APIs) not provided by us
• Attempt to bypass rate limits, access controls, or security measures
• Probe, scan, or test the vulnerability of the Service
• Use the Service in a manner that could damage, disable, or impair the Service

5. Intellectual Property Rights

5.1 Our Intellectual Property:

• The App, Service, and all content (except Bible text translations) are owned by Daily Bible App and protected by copyright, trademark, and other intellectual property laws
• You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes only
• This license does not include the right to resell, redistribute, or create derivative works

5.2 Bible Text Copyrights:

• Bible translations are provided under their respective copyright holders' terms
• All rights to Bible translations remain with their respective copyright holders
• You may not reproduce, distribute, or create derivative works from Bible text for commercial purposes
• Use of Bible text is subject to the copyright terms of each translation

5.3 User-Generated Content:

• You retain ownership of content you create (notes, highlights, bookmarks)
• By using the Service, you grant us a license to store, display, and process your content to provide the Service
• You represent that your content does not violate any third-party rights

6. Service Availability and Modifications

6.1 Service Availability:

• We strive to provide continuous access but do not guarantee uninterrupted or error-free service
• The Service may be unavailable due to maintenance, updates, or unforeseen circumstances
• We are not liable for any loss or damage resulting from Service unavailability

6.2 Service Modifications:

• We reserve the right to modify, suspend, or discontinue any part of the Service at any time
• We may add, remove, or change features without prior notice
• We may impose limits on certain features or restrict access to parts of the Service
• We are not obligated to maintain or support any specific feature or functionality

7. Termination

7.1 Termination by You:

• You may stop using the Service at any time
• You may delete your account through the app settings
• Upon account deletion, your data will be deleted in accordance with our Privacy Policy

7.2 Termination by Us:

• We reserve the right to suspend or terminate your account immediately, without prior notice, for any violation of these Terms
• We may terminate accounts that are inactive for extended periods
• We may terminate accounts that engage in prohibited activities or abuse the Service
• Upon termination, your right to use the Service will immediately cease
• We may delete your account and data upon termination, subject to legal requirements

7.3 Effect of Termination:

• All licenses and rights granted to you will immediately terminate
• You must cease all use of the Service
• Sections of these Terms that by their nature should survive termination will survive

8. Monitoring and Enforcement

8.1 Monitoring:

• We reserve the right to monitor your use of the Service to ensure compliance with these Terms
• We may use automated systems to detect abuse, fraud, or violations
• We may review accounts and content for compliance purposes

8.2 Enforcement Actions:

We may take any action we deem appropriate for violations, including but not limited to:

• Issuing warnings
• Suspending or terminating accounts
• Restricting access to features
• Removing content
• Reporting violations to law enforcement
• Pursuing legal remedies

8.3 No Obligation:

• We are not obligated to monitor the Service or enforce these Terms
• Our failure to enforce any provision does not constitute a waiver of that provision

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED
• WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• WE ARE NOT LIABLE FOR LOSS OF DATA, PROFITS, OR BUSINESS OPPORTUNITIES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (IF ANY)
• WE ARE NOT RESPONSIBLE FOR THIRD-PARTY SERVICES, INCLUDING FIREBASE, GOOGLE, OR APPLE SERVICES

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Daily Bible App, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit, post, or transmit through the Service
• Your violation of any applicable law or regulation

11. Dispute Resolution

11.1 Governing Law:

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Daily Bible App operates, without regard to conflict of law principles.

11.2 Dispute Resolution Process:

• You agree to first contact us to attempt to resolve any dispute informally
• If informal resolution fails, disputes shall be resolved through binding arbitration (if applicable in your jurisdiction)
• You waive any right to participate in a class-action lawsuit or class-wide arbitration

11.3 Jurisdiction:

You consent to the exclusive jurisdiction and venue of courts in the jurisdiction where Daily Bible App operates for any disputes not subject to arbitration.

12. In-App Purchases and Subscriptions

12.1 Pro Subscription:

• The Service offers a Pro subscription ("Pro Lifetime") that provides access to premium features
• Pro subscription is a one-time, non-refundable purchase (unless required by law)
• Pro features include ad-free experience, extended history, advanced notes, and other premium features
• Pro subscription is tied to your account and device

12.2 Purchase Terms:

• All purchases are processed through Google Play Store (Android) or Apple App Store (iOS)
• Prices are displayed in your local currency and may vary by region
• You agree to pay all charges associated with your purchase
• Purchases are final unless required by law or platform store policies

12.3 Refund Policy:

• Refund requests must be submitted through Google Play Store or Apple App Store
• Refund eligibility is determined by the platform store policies
• We do not process refunds directly
• Upon refund, Pro features will be immediately disabled

12.4 Purchase Verification:

• We verify purchases with the platform stores to prevent fraud
• Pro status may be verified periodically to ensure continued access
• If purchase verification fails, Pro features may be disabled
• You can restore purchases through the app settings if Pro features are not recognized

12.5 Subscription Changes:

• We reserve the right to modify Pro features, pricing, or subscription terms
• Changes to Pro features will not affect existing Pro subscribers for a reasonable period
• We will notify users of significant changes to Pro features or pricing

13. Advertising

13.1 Ad-Supported Service:

• The free version of the Service is supported by advertisements
• Advertisements are provided by Google Mobile Ads SDK and third-party advertisers
• Ads may be personalized based on your device information and app usage
• Pro users do not see advertisements

13.2 Ad Content:

• We do not control the content of advertisements displayed by third-party ad networks
• Advertisements may link to external websites or services
• We are not responsible for the content, products, or services offered in advertisements
• Clicking on advertisements is at your own risk

13.3 Ad Personalization:

• Ads may be personalized using data collected by Google Mobile Ads SDK
• You can control ad personalization through your device settings
• Disabling ad personalization may result in less relevant ads but will not remove ads for free users

13.4 Ad Blocking:

• You may not use ad-blocking software or methods to remove ads from the free version
• Attempting to block ads may violate these Terms and result in account termination
• To remove ads, you must purchase the Pro subscription

14. Third-Party Services

The Service integrates with third-party services, including:

14.1 Authentication Services:

• Google Sign-In: For authentication and account creation
• Apple Sign-In: For authentication and account creation
• Your use of these services is subject to their respective terms and privacy policies

14.2 Cloud Services:

• Firebase (Google): For authentication, database, storage, and messaging
• Your data stored on Firebase is subject to Firebase's terms and privacy policy

14.3 Advertising Services:

• Google Mobile Ads SDK: For displaying advertisements
• Third-party advertising networks: For ad delivery and personalization
• Ad data collection is governed by Google's privacy policies

14.4 Payment Processing:

• Google Play Store: For Android in-app purchases
• Apple App Store: For iOS in-app purchases
• Payment processing is subject to the platform stores' terms and policies

14.5 Bible Content Services:

• API.Bible: For certain Bible versions (e.g., NIV)
• Local Bible data: Public domain Bible versions stored locally

14.6 Third-Party Liability:

• We are not responsible for third-party services and disclaim all liability related to them
• Your use of third-party services is at your own risk
• Please review third-party terms and privacy policies before using their services

15. User-Generated Content

15.1 Your Content:

• You retain ownership of content you create, including notes, highlights, bookmarks, and prayer journal entries
• By using the Service, you grant us a license to store, display, and process your content to provide the Service
• You are solely responsible for the content you create

15.2 Content Restrictions:

• You may not create content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• You may not create content that violates intellectual property rights
• You may not create content that contains viruses, malware, or harmful code

15.3 Content Removal:

• We reserve the right to remove any content that violates these Terms
• We may remove content without prior notice if it violates our policies
• You can delete your own content at any time through the app

15.4 Content Backup:

• We recommend backing up important content
• We are not responsible for loss of content due to account deletion, app uninstallation, or technical issues
• Content may be synced to your account for backup purposes

16. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

By using the Service, you acknowledge that:

• We collect and use data as described in our Privacy Policy
• Third-party services (Google, Apple, Firebase, etc.) may collect data according to their privacy policies
• Advertising data is collected by Google Mobile Ads SDK as described in our Privacy Policy
• You consent to data collection and processing as described in our Privacy Policy

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Updating the "Last Updated" date at the top of these Terms
• Providing notice through the App (for significant changes)
• Sending an email notification (for major changes affecting Pro features or pricing)

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service and delete your account.

For Pro subscribers, significant changes to Pro features or pricing will be communicated in advance, and existing subscribers will be grandfathered into current terms for a reasonable period.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Daily Bible App regarding the Service and supersede all prior agreements and understandings.
